PENNSYLVANIA — A 27-year-old man from Honduras was sentenced to time served after pleading guilty in federal court to illegally reentering the United States following a previous deportation, Acting U.S. Attorney Troy Rivetti announced this week.
Luis Fernando Diaz-Garcia received a sentence of approximately 92 days in federal custody from Senior U.S. District Judge Nora Barry Fischer on April 29, 2025.
He has been in custody since his arrest on January 27 and will now be transferred to immigration authorities.
According to court records, Diaz-Garcia was arrested by Pennsylvania State Police after he nearly side-swiped a marked police vehicle.
He was charged with driving under the influence, driving without a license, and other traffic violations—charges that remain pending.
Following his arrest, immigration officials discovered Diaz-Garcia was in the country illegally. He had previously been deported on November 13, 2019, and had not obtained permission to return.
The case was prosecuted by Assistant U.S. Attorney Rebecca L. Silinski as part of Operation Take Back America, a Department of Justice initiative targeting illegal immigration and transnational crime. U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations conducted the investigation.
